Welcome to the Om Namasivaya Charitable Trust (ONSCT). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and related services (collectively, the "Services").

  • Spiritual & Charitable Intent: This platform is strictly for humanitarian, charitable, and spiritual purposes. You agree to use the site in a manner consistent with these values.

  • Prohibited Activities: You agree not to:

    • Use the site for any unlawful, fraudulent, or malicious purpose.

    • Attempt to gain unauthorized access to our administrative portals, databases (XML/MySQL), or Telegram alert systems.

    • Distribute viruses, malware, or any other harmful code.

    • Scrape or harvest data from our Digital Library or Temple Routemap for commercial use.

2. Donations and Financial Transactions

  • Voluntary Contributions: All donations made through our portal are voluntary and non-refundable. Once a transaction is successful, the funds are immediately allocated to the respective humanitarian or spiritual initiatives (e.g., Annadhanam, Temple Renovation, Blood Bank).

  • Payment Processing: We use third-party, RBI-compliant payment gateways (e.g., Cashfree) to process transactions. We do not store your credit/debit card numbers or UPI PINs on our servers.

  • Tax Exemptions: If your donation is eligible for tax exemption under section 80G of the Income Tax Act (or relevant local laws), it is your responsibility to provide accurate PAN card and address details. ONSCT is not liable for receipt generation failures due to incorrect information provided by the donor.

3. Digital Library (E-Books) Usage

  • Non-Commercial Use: The Hindu Puranas, Ithihasas, and historical texts provided in our Digital Library are for personal, educational, and spiritual enrichment only.

  • Copyright Restrictions: You may download and read the free e-books, but you are strictly prohibited from reselling, modifying, or repackaging our digital content for commercial gain.

4. User-Submitted Content and Feedback

  • By submitting feedback, contact requests, or volunteer forms, you grant ONSCT the right to review, store, and act upon the information provided.

  • You agree that any information submitted through our forms is accurate, truthful, and free of abusive, defamatory, or offensive language. ONSCT reserves the right to delete messages or block users who violate this rule.

5. Intellectual Property

  • All content, logos, designs, graphics, and software on this website are the property of Om Namasivaya Charitable Trust or its content suppliers and are protected by Indian and international copyright laws.

  • You may not use the ONSCT name, logo, or branding without our prior written, official consent.

6. Disclaimer of Warranties

  • "As-Is" Basis: Our Services, including the Temple Routemap, Digital Library, and Event Schedules, are provided on an "AS IS" and "AS AVAILABLE" basis.

  • Accuracy of Information: While we strive to provide accurate timings, temple histories, and maps, we do not warrant that all information is perfectly accurate, complete, or current. Temple timings and event schedules are subject to change without prior notice.

  • We make no warranties that the site will be uninterrupted, error-free, or entirely free of viruses, though we utilize advanced technical measures to ensure security.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Om Namasivaya Charitable Trust, its trustees, volunteers, and technical administrators shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of, or inability to use, our Services. This includes, but is not limited to, delays in blood bank responses, discrepancies in routing maps, or payment gateway failures.

8. Indemnification

You agree to indemnify, defend, and hold harmless Om Namasivaya Charitable Trust and its affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the platform.

ONSCT reserves the right to update, modify, or replace these Terms of Service at any time without direct notice. We will indicate the "Effective Date" at the top of this page. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or your use of the website shall be subject to the exclusive jurisdiction of the courts located in Nagercoil, Tamil Nadu, India.
